Agreement to Terms. Your access to and use of https://wellnesscenterfishkill.com is conditioned on your acceptance of and compliance with these Terms. By using the Site, you agree to these Terms in full.
Service Description. This Site describes Pilates, Yoga, Reiki, Energy Healing, Sound Bath Healing provided by One Of a Kind Divine. Estimates and quotes are issued separately and superseded by signed agreements.
User Conduct. You are responsible for any information you submit and for maintaining the confidentiality of any account access. You agree to use the Site lawfully.
Acceptable Behavior. You agree not to misuse the Site, including unlawful activity, service disruption, unauthorized data collection, malware distribution, or impersonation.
IP Rights. All material on this Site is owned by One Of a Kind Divine or its content suppliers. Use of any content without prior written authorization is prohibited.
Payments. Pricing for services is provided in writing prior to work commencing. Payments are due per the terms of your service agreement. Refunds, when applicable, are governed by that agreement.
End of Use. One Of a Kind Divine may terminate your Site access at its discretion. Provisions that by their nature should survive will survive termination.
No Warranties. One Of a Kind Divine disclaims all warranties, express or implied, including merchantability and fitness for a particular purpose. Site use is at your own risk.
Cap on Damages. Liability of One Of a Kind Divine arising under these Terms is limited, in total, to the fees paid by you in the prior 12-month period.
Indemnification. You agree to indemnify and hold harmless One Of a Kind Divine from any claims, damages, or expenses arising out of your misuse of the Site or violation of these Terms.
Governing Law. These Terms are governed by the laws of the State of NY, without regard to conflict-of-laws principles. Any dispute will be brought in the state or federal courts located in NY.
Updates. One Of a Kind Divine reserves the right to update these Terms. The current version is always available on this Site, and continued use signifies acceptance.
